Sub-Saharan Africa: how to achieve a de jure moratorium on the death penalty?

Progress made towards abolition of the death penalty in Africa. Today, only 15 of the 48 States in Sub- Saharan Africa have abolished the death penalty in law (Togo and Burundi abolished it in 2009). However, despite the absence of reliable statistical data, 17 African States are considered to be de facto abolitionists. Regional agreements supporting abolition. Article 4 of the African Charter on Human and Peoples’ Rights sets out that “every human being shall be entitled to respect for his life”. However, this convention does not explicitly prohibit the used of the death penalty. The creation of a Protocol on the death penalty in Africa was discussed at a conference in Kigali in September 2009 organised by the African Commission on Human and Peoples’ Rights.
